The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

Once capitalism’s responsibility in the current ecological crisis is recognized, the necessary response of ecology and environmental activism is insufficient to access the essence of the techno-science that decides our way of inhabiting the planet. The “heideggerian” eco-dicy proposes from the critique of the metaphysical essence of the technique, a new understanding of dwelling that does justice to the different modalities of the living from the ontological difference in which our dwelling of the Earth finds its meaning.

According to standard assumptions in semantics, ordinary users of a language have implicit beliefs about the truth-conditions of sentences in that language, and they often agree on those beliefs. For example, it is assumed that if Anna and John are both competent users of English and the former utters ‘grass is green’ in conversation with the latter, they will both believe that that sentence is true if and only if grass is green. These assumptions play an important role in an (...) intuitively compelling picture of communication, according to which successful communication through literal assertoric utterances is normally effected thanks to our shared beliefs about the truth-conditions of the sentences uttered in the course of the conversation. Against these standard assumptions, this paper argues that the participants in a conversation rarely have the same beliefs about the truth-conditions of the sentences involved in a linguistic interaction. More precisely, it argues for Variance, the thesis that nearly every utterance is such that there is no proposition which more than one language user believes to be that utterance’s truth-conditional content. If Variance is true, we must reject the standard picture of communication. Towards the end of the paper I identify three ways in which ordinary conversations can be communication-like despite the truth of Variance and argue that the most natural amendments to the standard picture fail to explain them. Indirect speech reports can be true even if they attribute to the speaker the saying of something weaker than what she in fact expressed, yet not all weakenings of what the speaker expressed yield true reports. For example, if Anna utters ‘Bob and Carla passed the exam’, we can accurately report her as having said that Carla passed the exam, but we can not accurately report her as having said that either it rains or it does not, or that either (...) Carla passed the exam or pandas are cute. This paper offers an analysis of speech reports that distinguishes weakenings of what the speaker expressed that yield true reports from weakenings that do not. According to this analysis, speech reports are not only sensitive to the informational content of what the speaker expressed, but also to the possibilities a speaker raises in making an utterance. As I argue, this analysis has significant advantages over its most promising competitors, including views based on work by Barwise and Perry : 668–691, 1981), views appealing to recent work on the notion of content parthood by Fine :199–226, 2016) and Yablo, and Richard’s : 605–616, 1998) proposal appealing to structured propositions. The propositional view of communication states that every literal assertoric utterance of an indicative sentence expresses a proposition, and the audience understands those utterances only if she entertains the proposition(s) the speaker expressed. According to an important objection due to Ray Buchanan, the propositional view is ill‐equipped to handle meaning underdeterminacy. Using resources from situation semantics and MacFarlane's nonindexical contextualism, this article develops a view of literal communication close to the propositional view which overcomes Buchanan's underdeterminacy considerations while accounting for (...) the kind of indifference that typically characterizes speakers' intentions. This paper develops a puzzle about non-merely-verbal disputes. At first sight, it would seem that a dispute over the truth of an utterance is not merely verbal only if there is a proposition that the parties to the dispute take the utterance under dispute to express, which one of the parties accepts and the other rejects. Yet, as I argue, it is extremely rare for ordinary disputes over an utterance’s truth to satisfy this condition, in which case non-merely verbal disputes (...) are extremely rare. After examining various responses to the puzzle, I outline a solution using the framework of truthmaker semantics. (shrink)

El objetivo de este artículo es presentar una reconstrucción de la teoría de los grupos dereferencia. La teoría, desarrollada por Robert K. Merton, ha sido largamente utilizada enlos más variados campos de las ciencias sociales, aunque con escasa o nula consideraciónmetateórica hasta ahora. La reconstrucción atenderá a la presentación que de la misma serecoge en sendos artículos de su libro Social Theory and Social Structure, de 1968, a saber:“Contributions to the theory of reference group behavior” y “Continuities in the theory (...) ofreference groups and social structure”. Para presentar esta reconstrucción me apoyaré en elinstrumental de la Metateoría Estructuralista. Después de una consideración informal de lateoría, serán presentados sus modelos potenciales, modelos, modelos potenciales parciales,sus aplicaciones intencionales y algunos comentarios acerca de la noción de “grupo de referencia”en lo que respeta su carácter relacional y disposicional. Say that an audience understands a given utterance perfectly only if she correctly identifies which proposition (or propositions) that utterance expresses. In ideal circumstances, the participants in a conversation will understand each other’s utterances perfectly; however, even if they do not, they may still understand each other’s utterances at least in part. Although it is plausible to think that the phenomenon of partial understanding is very common, there is currently no philosophical account of it. This paper offers such an account. (...) This paper raises a new form of speaker error objection to the analysis of disputes as metalinguistic negotiations in cases in which disputants reject that analysis. It focuses on an obvious but underexplored form of speaker error: speakers’ misattribution of contents both to others and to themselves. It argues that the analyses of disputes that posit this type of speaker error are uncharitable in three different ways: first, by portraying speakers as mistaken interpreters of their interlocutors; second, by portraying speakers (...) as uncharitable interpreters of their interlocutors; third, by portraying speakers who retract their claims as mistaken interpreters of their own prior utterances. Taken together, these unfavorable consequences weigh significantly against the plausibility of this type of analysis for the cases in question. (shrink)

Esta marca lingüística, exclusiva de la lengua griega, justifica el hecho de que la filosofía sea función de la diferencia ontológica y que para aquella, ser y pensar sean lo mismo. Tentativas sobre filosofía griega recoge una serie de escritos que indagan en algunas de las cuestiones más características de la filosofía griega: la muerte de Sócrates, mito y filosofía, Platón y la poesía, Aristóteles y la verdad, entre otras. Una indagación que pretende trascender el ámbito meramente histórico en el que normalmente se sitúa al pensamiento griego antiguo, para desde una perspectiva filosófica contemporánea dotar de sentido actual a la discusión que contienen esos textos griegos. Los orígenes de esta propuesta (...) hay que buscarlos en la transición de los siglos XVIII a XIX, cuando el pensamiento europeo reconoce la importancia de llegar hasta lo genuinamente griego de las producciones del espíritu helénico. Pues durante mucho tiempo las interpretaciones y adaptaciones de lo griego, y en especial de la filosofía griega, según los diferentes intereses ideológicos de cada tradición cultural y religiosa, han vuelto irreconocible lo específico de la grecidad. Será a partir de la crítica ilustrada del XVIII, cuando va apareciendo en el pensamiento europeo una sensibilidad específica en relación a las obras del espíritu helénico. Los Hölderlin, Hegel, Nietzsche, Heidegger, entre otros muchos, han buscado desde la originariedad genuina de lo griego acceder a una experiencia cognitiva que se encuentra en los textos de la filosofía y el pensamiento griegos, y cuyo poder conceptual no sólo sostiene lo europeo, sino que se ha extendido planetariamente. Ignorarlo sería quedar a su merced. El modo perspectivista de abordar el estudio de la filosofía griega en los escritos que recoge el presente libro, pues es una recopilación de artículos aparecidos en los últimos años, no es óbice para que todos ellos respondan a la misma voluntad de sentido, sin que éste deje de ser plural. La convicción acerca de la imposibilidad de un relato sistemático, por reductivo, sobre el pensamiento y la filosofía griegos, justifica abordar estas cuestiones desde una escritura abierta sin renunciar por ello a dar forma a la trama desde la que se muestre lo genuinamente griego de la filosofía y el pensamiento helénicos. This paper provides an exploratory comparative assessment of the institutional pressures influencing corporate social responsibility in a developed country, UK, vs. a developing country, Brazil, based on a survey of different actors. Information on sustainability concerns, organizational strategies and mechanisms of pressure was collected through interviews with environmental regulatory agencies, financial institutions, media and non-governmental organizations. Our results confirm that the more advanced awareness and CSR responsiveness in the UK is a consequence of a predominance of coercive and normative forces (...) on the organizational field. The institutional forces tend to build a Brazilian organizational field that is relational based and risk intensive. The findings lend support to the view that CSR responses are unlikely to be easily transformed into uniform standardized practices across the globe. This paper contributes to a collective understanding of the organizational field and a common template for CSR in the context of developed and developing countries. (shrink)

To maximize brain plasticity after stroke, several rehabilitation strategies have been explored, including the use of intensive motor training, motor imagery, and action observation. Growing evidence of the positive impact of virtual reality (VR) techniques on recovery following stroke has been shown. However, most VR tools are designed to exploit active movement, and hence patients with low level of motor control cannot fully benefit from them. Consequently, the idea of directly training the central nervous system has been promoted by utilizing (...) motor-imagery (MI) based brain-computer interfaces (BCIs). To date, detailed information on which VR strategies lead to successful functional recovery is still largely missing, and very little is known about how to optimally integrate BCI and VR paradigms for stroke rehabilitation. The purpose of this study was to examine the efficacy of a BCI-VR system using a MI paradigm for post-stroke upper limb rehabilitation on functional assessments, and related changes in MI ability and brain imaging. To achieve this, a 60 years old male chronic stroke patient was recruited. The patient underwent a 3-week intervention in a clinical environment, resulting in 10 BCI-VR training sessions. The patient was assessed before and after intervention, as well as on a one-month follow-up, in terms of clinical scales and brain imaging using functional MRI (fMRI). Consistent with prior research, we found important improvements in upper extremity scores (Fugl-Meyer) and identified increases in brain activation measured by fMRI that suggest neuroplastic changes in brain motor networks. This study expands on the current body of evidence as more data are needed on the effect of this type of interventions not only on functional improvement but also through brain imaging to study the effect of the intervention on plasticity. While ethics in publishing has been increasingly debated, there seems to be a lack of a theoretical framework for making sense of existing rules of behavior as well as for designing, managing and enforcing such rules. This letter argues that systems-oriented disciplines, such as complexity science and human factors, offer insights into new ways of dealing with ethics in publishing. Some examples of insights are presented. Also, a call is made for empirical studies that unveil the context and details of (...) both retracted papers and the process of writing and publishing academic papers. This is expected to shed light on the complexity of the publication system as well as to support the development of a just culture, in which all participants are accountable. (shrink)

If Amelia utters ‘Brad ate a salad in 2005’ assertorically, and she is speaking literally and sincerely, then I can infer that Amelia believes that Brad ate a salad in 2005. This paper discusses what makes this kind of inference truth-preserving. According to the baseline picture, my inference is truth-preserving because, if Amelia is a competent speaker, she believes that the sentence she uttered means that Brad ate a salad in 2005; thus, if Amelia believes that that sentence is true, (...) then she must believe that Brad ate a salad in 2005. I argue that this view is not correct; on pain of irrationality, normal speakers can’t have specific beliefs about the meaning of the sentences they utter. I propose a new account, relying on the view that epistemically responsible speakers utter sentences assertorically only if they believe all the propositions which they think those sentences might mean. The persistent educational challenges that fractions pose call for developing novel instructional methods to better prepare students for fraction learning. Here, we examined the effects of a 24-session, Cuisenaire rod intervention on a building block for symbolic fraction knowledge, continuous and discrete non-symbolic proportional reasoning, in children who have yet to receive fraction instruction. Participants were 34 second-graders who attended the intervention (intervention group) and 15 children who did not participate in any sessions (control group). As attendance at the intervention (...) sessions was irregular (median = 15.6 sessions, range = 1–24), we specifically examined the effect of the number of sessions completed on their non-symbolic proportional reasoning. Our results showed that children who attended a larger number of sessions increased their ability to compare non-symbolic continuous proportions. However, contrary to our expectations, they also decreased their ability to compare misleading discretized proportions. In contrast, children in the Control group did not show any change in their performance. These results provide further evidence on the malleability of non-symbolic continuous proportional reasoning and highlight the rigidity of counting knowledge interference on discrete proportional reasoning. A escola de ensino de tempo integral tem assumido paulatinamente o lugar de referência para um novo modelo de educação pública nacional. Ancorada no desenvolvimento de competências, habilidades, conhecimentos específicos, atitudes e qualidades pessoais, elementos constitutivos do capital humano, ela tem fornecido aos estudantes uma formação cuja centralidade está no Projeto de Vida e na empresa si mesmo, a fim de responder as demandas de economias virtualizadas, que por sua vez, estão baseadas na competitividade e concorrência, condicionadas pelo forte processo (...) de financeirização do neoliberalismo. Partindo da análise de leis e documentos oficiais este artigo buscou conhecer e problematizar a operacionalização de novos dispositivos pela racionalidade neoliberal na formação de subjetividades no modelo de política pública educacional implantado em Pernambuco através Programa de Educação Integral (PEI) nas Escolas de Referência em ensino médio (EREMs), avaliando sua contribuição para formação de capital humano instrumentalizado pela lógica concorrencial e mão de obra precarizada. Utilizando-se dos conceitos da racionalidade neoliberal de Pierre Dardot e Christian Laval e de biopolítica de Michel Foucault, constatou-se que a implementação e execução do PEI operou uma ressignificação do Ensino Médio com o objetivo de formação de uma subjetividade específica, adaptada a flexibilidade produtiva da economia do conhecimento. Compreendeu-se que o Programa de Educação Integral produz uma escola utilitarista por essência, moldada conforme as diretrizes de padronização de sistemas de ensinos para países emergentes, determinadas por organizações internacionais como OCDE e Banco Mundial, atendendo a ordem global que diferencia países ricos e pobres. Conclui-se que apesar do discurso de inovação e modernidade o novo modelo de escola pública de ensino médio de tempo integral é um dispositivo biopolítico para forjar subjetividades dóceis. Ela é uma tecnologia de controle da governamentalidade neoliberal para formação de um capital humano precarizado e cidadanias fragilizadas. (shrink)

Este artigo tem como objetivo pensar as figurações feministas e o devir-mulher a partir da arte para refletir sobre subjetividades inventivas. Em seu conteúdo, aborda-se o contexto do lugar da mulher na arte, desde o apagamento das mulheres até a reapropriação desse espaço pelos movimentos feministas. Para refletir sobre a arte, são apresentados os conceitos de devir e de figuração, bem como artistas que dialogam com esses conceitos. Sob o aporte teórico feminista, o trabalho aponta a arte como um meio (...) de resistência na produção de novas narrativas pelas figurações, além de um estado de devir como resistência, desconstrução e reconstrução, e um modo de viver mais libertário por parte das mulheres.Palavras-chave: Estética feminista. Se presenta una investigación cualitativa cuyo objetivo es realizar una aproximación a las percepciones que el profesorado en formación inicial (PFI) del Grado en Educación Infantil (EI) tiene con respecto al conocimiento de diferentes cuestiones relacionadas con la enseñanza y el aprendizaje de las ciencias, Se diseñó y aplicó un formulario Knwoledge and Prior Study Inventory (KPSI) y se realizó una revisión de la Memoria para la solicitud de verificación de títulos oficiales del Grado en EI. Los resultados muestran evidencias (...) de la necesidad de formación que el PFI presenta en lo relativo a la enseñanza de las ciencias. (shrink)

Este relato apresenta brevemente a experiência de uma atividade realizada com alunos de ensino médio, no Subprojeto de Filosofia do PIBID UFFS Campus Chapecó, na qual foram abordados os conceitos de Eros e Philia em Platão e Aristóteles. A atividade foi pensada juntamente com o coordenador e o supervisor do subprojeto e aplicada aos alunos do 2º ano do Ensino Médio noturno da Escola Coronel Lara Ribas, onde são desenvolvidas as atividades do Subprojeto de Filosofia da UFFS, sendo realizada durante (...) o segundo semestre de 2012. A atividade envolveu todas as etapas fundamentais de uma atividade de docência, a saber: escolha do tema, planejamento, pesquisa dos conteúdos, definição da metodologia, aplicação na sala de aula e avaliação. A temática utilizada nas aulas, envolvendo os conceitos de Eros e Philia, foi fundamentada nas obras de Platão e Aristóteles, que foram lidos e debatidos pelos alunos em sala de aula. O objetivo central da atividade foi possibilitar compreensão desses dois conceitos, Eros e Philia, no pensamento de Platão e Aristóteles, por parte dos alunos do ensino médio. Metodologicamente, foram desenvolvidas várias atividades, como a leitura dos textos clássicos, apresentação de material audiovisual, análise de letras de música e debates. Esta prática contribuiu para a formação docente do bolsista, exigindo uma compreensão maior dos textos clássicos, domínio dos conteúdos, planejamento e reflexão sobre metodologias para o desenvolvimento dos temas. Esta experiência contribuiu ainda para que o acadêmico percebesse a sala de aula como um espaço de atuação/formação inicial e permanente, no qual é necessário sempre refletir sobre a qualidade do ensino, bem como a promoção da articulação entre a teoria e a prática dos saberes acadêmicos que promovem uma formação integral do aluno de licenciatura. O objetivo deste artigo é apresentar como o filósofo alemão Martin Heidegger propõe um retorno ao pensamento do ser. Em primeiro lugar, ele indica a importância de uma questão fundamental, a qual ficou esquecida pela tradição metafísica. Seu argumento revela que o pensamento do ser consiste na essência do pensar. Diante das ciências e da técnica, Heidegger defende a necessidade de resgatar pensamento do ser como uma tarefa primordial da existência humana e que nos possibilita fazer as perguntas em torno (...) do sentido que os entes, o Ser em geral e nós mesmos possuímos. O presente artigo visa propor uma transformação na pedagogia formal, que exclui, violenta e silencia bocas não contempladas pelos padrões hegemônicos de normalidade, propondo então uma pe-drag-ogia, inventiva, pirateadora, amorfa e transformista. Para tal, busca-se entender algumas das instâncias que violentam as sujeitas desviantes das normas hegemônicas de ser e estar no mundo, cruzando com propostas pedagógicas, teóricas, práticas e artísticas de emancipação, resistência e afronte. A metáfora de pintar a boca diz de ouvir os lugares de fala há tempos (...) negligenciados nas plataformas formais, como bocas trans, bocas negras, bocas mulheres, bocas abjetas. Conclui-se, então, que a pe-drag-ogia não é uma invenção, mas uma tradução pedagógica de movimentos artísticos dissidentes já existentes. Palavras-chave: Pedagogia; Drag Queen; Travesti. (shrink)

O trabalho analisa, por meio da cobertura do diário A Tarde, de Salvador, a convivência entre a delegação alemã de futebol e a população local de Santa Cruz Cabrália, no sul da Bahia, que serviu de base para a seleção que conquistou a Copa do Mundo de futebol em 2014. A partir dos critérios de identidade cultural, globalização e seleção jornalística, mostra que a estratégia de aproximação com os moradores marcou a cobertura de A Tarde e criou um clima simpático (...) à seleção alemã.
